General terms and conditions of the Pasos de Zapato Feroz loyalty program

I. PURPOSE OF THESE TERMS AND CONDITIONS

The purpose of this document is to establish the General Terms and Conditions (hereinafter, the “T&CG”) that define the characteristics and operating conditions of the loyalty program (“Steps”) aimed at customers and potential customers (the “Participants” or the “Participant”) of Creaholic, SL, a company with registered office at Calle 417, nº 12, La Cañada - Paterna (46182), Valencia, Spain and provided with CIF number B98736598 (hereinafter, “Zapato Feroz”).

By joining the Pasos program, the Participant expressly accepts and adheres without reservation to these Terms and Conditions.

II. LOYALTY PROGRAM

The Loyalty Program (Steps) is based on the accumulation and redemption of Steps (points) generated through purchases, as well as other actions detailed below, carried out by Participants through our website (www.zapatoferoz.es) or in our physical store (Ferozland). Both are hereinafter referred to as " Loyalty Program Channels ."

Points ("Steps") will be accumulated in the Participant's account or profile on the Zapato Feroz website in order to obtain discounts on subsequent purchases of products available on the Loyalty Program Channels.

Zapato Feroz reserves the right to verify the Participant's identity for any reason related to the Pasos program (i.e., making purchases, returns, accumulating and redeeming Pasos, enjoying associated benefits, etc.). Identification may be carried out through the mechanisms detailed in Section IV below.

III. ADHERENCE TO THE LOYALTY PROGRAM

Those wishing to join the Steps simply need to create a customer account on the Zapato Feroz website by completing the online registration form . Registration on the Zapato Feroz website automatically entails membership and is free of charge.

Users registered with Zapato Feroz automatically become part of the program without having to do anything:

IV. OBTAINING STEPS (POINTS)

Once registered in the Steps program, each Participant may accumulate Steps (points) through the following means:

(i) Accumulation of Steps (points) for making purchases through any of the Loyalty Program Channels:

The Steps (points) may not be transferred or exchanged for cash or for their value in kind.

V. EXCHANGE OF STEPS (POINTS) OBTAINED

The Steps (points) earned by Participants will be accumulated in the Participant's balance and may be redeemed through a discount coupon on the Participant's next purchases made through the Loyalty Program Channels.

The minimum order to use the Steps is €20, not including shipping costs.

A maximum of 5,000 Steps (€50 discount) may be used in a single order.

Steps (points) may be accumulated with other promotions with direct discounts; however, they cannot be combined with discount coupons, so the Participant must choose whether to redeem a discount coupon or prefer to redeem their Steps (points).

The exchange of the Steps (points) as their own accumulation will be made in whole numbers, rounded up.

The Participant may consult the Steps (points) available for redemption, as well as the actions carried out in the “My Movements” section available in the “Steps” section within the corresponding section on the Zapato Feroz website.

VI. VALIDITY OF STEPS (POINTS) AND CANCELLATION FROM THE LOYALTY PROGRAM

The Steps (points) obtained for purchases made by the Participant will be valid for twelve (12) months from the date of acquisition of the order in which the points were generated. Steps (points). The Participant will be notified of the expiration of the Steps (points) via email with two advance notices, first one 30 calendar days before its expiration and another 4 calendar days before its expiration.

Discount coupons generated through the Pasos program will expire 30 days after being issued. If a coupon has not been used and expires, the Pasos will be replenished in the customer's account.

In the event that the Participant decides to unsubscribe from our Customer Database, Steps (points) accumulated to date will disappear and cannot be recovered.

VII. RETURN OF PRODUCTS

In the event of a return of one or more products from an order, the Total steps (points) of the order will be deducted from the Participant's account.

When making a product exchange, through our exchange and returns portal, no deductions will be made. Participant Steps (points). This change will also not generate new Steps (points) in your account.

Likewise, any coupons used on that order will be lost and cannot be recovered.

VIII. CONSULTATION OF STEPS (POINTS) AND CATEGORY

After making any purchase, the Participant may check his or her balance. Steps (points) in the “Steps” section on the Zapato Feroz website.

IX. COMMUNICATIONS

Zapato Feroz will send its electronic communications related to the Pasos program, by email, to the email address provided by the Participant at the time of creating their account, through announcements or notifications on the Zapato Feroz website.

Among others, the following will be communicated: (i) reminders or news about the benefits of the Pasos; (ii) the proximity to the expiration of the Steps (points) or (iii) any other communication that directly or indirectly affects the development of the Steps program.

X. PROCESSING OF PERSONAL DATA

Information on the processing of Participants' personal data is contained in the Privacy Policy.

XI. MODIFICATION AND CANCELLATION OF THE T&Cs

Zapato Feroz reserves the right to unilaterally modify the Terms and Conditions. Notwithstanding the foregoing, the latest version of the Terms and Conditions applicable to the Pasos can be found on the Zapato Feroz website.

Zapato Feroz also reserves the right to modify, suspend or cancel the Pasos program, in which case Participants will be informed through the Zapato Feroz website.

In the event of cancellation of the Pasos program, Participants will have a maximum period of 30 days to redeem their Loyalty Program Membership through any of the Loyalty Program Channels. Steps (points) accumulated to date. If this is not done, these Steps (points) will be lost.

In the event of force majeure, the Pasos program may be suspended or canceled without prior notice to Participants.

XII. RESPONSIBILITY

Any modification or cancellation of the Pasos program by Zapato Feroz will not entitle the Participant to any compensation of any kind.

Participation in the Pasos program requires compliance with the Terms and Conditions. Consequently, Zapato Feroz reserves the right to terminate the Participant's membership in the Pasos program and cancel any associated benefits or advantages if a Participant engages in any conduct that constitutes a breach of these Terms and Conditions. In any case, Zapato Feroz will terminate the Participant's membership in the Pasos program without prior notice and by any means it deems most appropriate, without the Participant being entitled to any compensation, in the following cases:

(i) in the event of fraud, theft or attempted fraud or theft in the store by the Participant.

(ii) in case of inappropriate use of the Steps.

(iii) in the case of actions that seek to alter the proper functioning of the Pasos program.

Zapato Feroz will not be held responsible for the consequences caused by the lack of communication with the Participant when said lack of communication is due to a malfunction of the email address or the inaccuracy of the information provided by the Participant.

Zapato Feroz cannot guarantee the availability and continued operation of the Pasos program, particularly in the event of a technical malfunction of computer systems, servers, or computer equipment, internet malfunction, data destruction due to hacking or error, or any other technical problem that may occur.

Whenever reasonably possible, Zapato Feroz will notify the Participant of any interruptions in the operation of the Pasos program. Therefore, Zapato Feroz assumes no liability for damages of any kind that may arise due to the lack of availability or continuity of the Pasos program.

Zapato Feroz will not be responsible for any taxes that may accrue to Participants as a result of their participation in the Pasos program.

XIII. ENTRY INTO FORCE

These T&CG will enter into force on July 1, 2025.

XIV. APPLICABLE LAW AND JURISDICTION

These T&CG shall be governed by common Spanish law.

Zapato Feroz and the Participant, expressly waiving any other jurisdiction that may apply, expressly submit to the jurisdiction of the courts of the city of Valencia for the resolution of any disputes that may arise from the interpretation of these Terms and Conditions. However, when required by applicable local law, any dispute will be resolved in the jurisdiction of the Participant's domicile or habitual residence.
